These General Terms and Conditions govern the relationship between:
- STANDARD FORMULA SA, owner of the nobis.ch website, and
- the internet user, who agrees to the nobis.ch general terms and conditions, hereinafter referred to as the customer.
ARTICLE 1: PRODUCTS
1.1 Descriptions of products for sale are provided on the nobis.ch website at the time of purchase.
1.2 Products are available via the website, subject to stock availability.
ARTICLE 2: PRICING, COST OF DELIVERY, ADMINISTRATIVE FEES
2.1 Prices are net, in the currency selected by the internet user (CHF, USD or EUR), inclusive of VAT; prices shall apply for the duration of a purchase.
2.2 The cost of delivery is set out in the "basket" section of the order form and added to the indicated price.
ARTICLE 3: COMPLETION OF PURCHASE, PAYMENT, CANCELLATION, CONFIDENTIALITY
3.1 A purchase is completed once the customer confirms his/her basket by clicking on the "CONFIRM" button and receives confirmation by email.
3.2 The amount for purchases made on the nobis.ch website is payable in full at the time of order; payment shall be made by bank-issued credit card (Visa, Mastercard, PostCard)
3.3 STANDARD FORMULA SA does not have access to confidential information regarding the method of payment. Information provided is encrypted and sent securely to payment processing company Concardis and cannot be accessed by STANDARD FORMULA SA or any third parties.
3.4 STANDARD FORMULA SA reserves the right not to offer particular payment methods and to require that payment be made by other available methods. STANDARD FORMULA SA shall not be required to give reasons for its decision in such cases.
3.5 STANDARD FORMULA SA reserves the right to refuse, at its discretion and at any time, orders that it receives. STANDARD FORMULA SA shall not be obligated to give reasons for its decision in such cases.
3.6 STANDARD FORMULA SA reserves the right to cancel an order in the event of a pricing error due to a technical problem or processing error. All photos are non-contractual and may differ from the actual product.
ARTICLE 4: DELIVERY
4.1 Products are dispatched by DHL Express or other transport companies to the delivery address specified by the customer when making the order.
4.2 Unless specifically stated otherwise when the order is confirmed, delivery shall be completed within three to five working days.
4.3 STANDARD FORMULA SA undertakes to notify the customer of any significant delay in delivery or unavailability of a product. STANDARD FORMULA SA shall not be required to pay compensation on such grounds.
4.4 Delivery charges are specified in the "basket" section of the order form and must be approved by the customer before confirming every order.
4.5 Parcels delivered by DHL Express or other transport companies which have not been claimed or have been refused shall be automatically returned to the sender (STANDARD FORMULA SA) with return costs. Once received, the customer shall be contacted by email within a reasonable time frame to arrange a new delivery time, and it will no longer be possible to make cancellations. The customer shall be responsible for the cost of returns and forwarding. Absent any update from the customer within three months (of the date of dispatch), STANDARD FORMULA SA shall not be required to provide a refund or exchange, nor to pay compensation in such cases.
4.6 For multiple orders, we reserve the right to group items into a single postal item.
4.7 Parcels delivered by DHL Express or other transport companies to the letter box or an annex are the customer's responsibility; STANDARD FORMULA SA shall not be held liable for any compensation in the event of theft.
ARTICLE 5: WARRANTY AGAINST DEFECTS, RETURNS POLICY
5.1 In the case of a defective product, STANDARD FORMULA SA's warranty shall be limited to the return of the product and a refund of the amount paid or replacement less transport cost.
5.2 Products must be returned in their original packaging and placed in a protective box. Customers are advised to retain the consignment number of the return parcel for ease of reference.
5.3 The customer shall be responsible for the cost of postage.
5.4 There is no refund or exchange on discounted products (Legacy Event).
ARTICLE 6: MONEY BACK GUARANTEE, RETURNS POLICY
6.1 Regardless of the presence of defects, customers may return their order at their own expense within seven calendar days of the dispatch date (authenticated by DHL Express or other transport companies postmark).
6.2 Products must be returned in their original packaging and placed in a protective box. Customers are advised to retain the consignment number of the return parcel for ease of reference.
6.3 Returns made in accordance with Articles 6.1 and 6.2 above shall be eligible for a refund of the amount paid. The customer shall specify in a letter the details of the bank or postgiro account (IBAN) into which the refund should be paid.
6.4 If the product is not defective, the cost of delivery shall be borne by the customer and shall not be refunded.
ARTICLE 7: AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS
7.1 STANDARD FORMULA SA may amend these general terms and conditions at any time.
7.2 It is the customer's responsibility to remain informed of the content of any amendments to these general terms and conditions, by visiting nobis.ch.
ARTICLE 8: APPLICABLE LAW AND JURISDICTION
8.1 The relationship between STANDARD FORMULA SA and the customer is subject to Swiss law.
8.2 For all legal disputes concerning the relationship between STANDARD FORMULA SA and the customer, the court with jursidiction for the registered office of STANDARD FORMULA SA in Lausanne shall have competence.
NOBIS.CH WEBSITE TERMS OF USE
- ACCEPTANCE AND AMENDMENT OF TERMS OF USE
1.1 Access to and use of the Standard Formula website, nobis.ch (hereinafter the "Site"), is subject to these terms of use (hereinafter "Terms of Use"). By accessing, browsing and using our Site, you acknowledge that you have read, understood and unreservedly accepted the Terms of Use, which we may amend from time to time.
1.2 Should we make changes to our Terms of Use, we will upload the new version to our Sites. We therefore encourage you to regularly consult these Terms of Use to become familiar with any changes.
- USE OF THE SITE
2.1 You are permitted to download, present or print the content of our Sites for personal use and non-commercial purposes only, taking care to save and make a copy of all copyright and other intellectual property notices included in information or any other material that you download. All other use, including the reproduction, modification, distribution, transmission or circulation of Site material, in full or in part and by any method, is strictly prohibited, without the prior written consent of STANDARD FORMULA SA.
2.2 STANDARD FORMULA SA does not guarantee that your use of content featured on its sites does not infringe on the rights of third parties.
- LIMITATION OF LIABILITY
3.1 You access, use and browse our Sites entirely at your own risk.
3.2 You acknowledge and accept, to the fullest extent possible under applicable law, that STANDARD FORMULA SA, its affiliated companies or companies involved in the creation, production or delivery of the Site, may not be held liable for any direct, indirect or accidental damages, or for the reparation of non-pecuniary damages, loss of turnover or lost profit, or financial liabilities of any kind (even where the occurrence of such losses was known to, or might have been foreseen by, STANDARD FORMULA SA), resulting from the use or unavailability of the sites or their content.
3.3 All material downloaded or obtained by any other method when using our site is done so entirely at your own risk. STANDARD FORMULA SA assumes no liability for damages or viruses that could harm your computer or system hardware resulting from accessing or using the Site, downloading material from the Site, or for any unlawful interference with computer systems.
3.4 STANDARD FORMULA SA. reserves the right to interrupt or suspend some or all of the services of its Sites. STANDARD FORMULA SA accepts no liability whatsoever for any interruption or suspension to some or all of the services of its Site resulting from actions or oversights by STANDARD FORMULA SA or third parties.
